overpayment for a minor child

I have had my minor son for 6 months now during that time his mother was his payee and he did not see a dime. A few years back I can remember she got some lump sum payments.  I just got control of his funds yesterday and now they are saying there was an overpayment and he has to pay it back Seems like the payee should be responsible during that time period?

The one that has their SS # on the money is the liable party - the payee is responsible for making sure the amount of the overpayment is correct but it will either be taken from the minor child’s benefit, or if no longer getting a benefit, paid back or it will stay on their account until they can collect it somewhere in the future.  You can file an appeal of the overpayment if you think it is wrong or you can file a waiver.

Since you are now the Rep. Payee now perhaps there was a problem with the last one.
