"mens rea - that has been explored. It's called the "She is too stupid to know" defense. She was Secretary of State - how stupid could she possibly be about the handling of official material??"

Whoever wrote this is an idiot. Here is the meaning of mens rea that we learned in law school:

Mens Rea refers to criminal intent. The literal translation from Latin is "guilty mind." The plural of mens rea is mentes reae. A mens rea refers to the state of mind statutorily required in order to convict a particular defendant of a particular crime. S Establishing the mens rea of an offender is usually necessary to prove guilt in a criminal trial. The prosecution typically must prove beyond reasonable doubt that the defendant committed the offense with a culpable state of mind

It has zero to do with being too stupid or anything to do with "knowing" what it means is criminal intent was not there. There were 7 e-mails out of hundreds of thousands of e-mails. mena rea just isn't there.

"Gorsuch was in a Presidential election your and long standing tradition is that when there is a Party split between the Congress and WH nominations do not occur in such years. That did not apply in the case Kavanaugh."

THAT IS 100% untrue and I pointed out at least 2 times/years where it did NOT happen. That is a BIG FAT McConnell lie. PERIOD. If you want to buy it, feel free. I work in the legal profession and I do not know a single lawyer that bought that fairy tale. McConmnmell ;eft that seat open for 422 days to disenfranchise Barack Obama. PERIOD!!

@rk9152- you're off topic - again.

So would I ever apologise to Kavanaugh and his family?

Of course not.

His wife knew what she was marrying - she stayed with him despite what he is.

His children could have petetioned the court for foster parents...

Don't try to complicate things via inaccuracy. Hillary used a private server. The others used a private email address.

Based on your last statement - which Bush people used a private server and wiped it clean??

I see facts don’t matter when they don’t fit your opinion. Hillary’s private server was much more secure than any public server used by the previous SoSs.

Those who used a private server during the GWBush administration included GWBush and Dick Cheney as well as most Cabinet members.

You claim that Bush people including Colin Powell used private servers. He used a private email address on a public server.

If you have proof of any Bush Cabinet Member using a private server and erasing the messages as Hillary did - please post it.

Yes, some used an RNC address and yes some messages got lost (but later found). But, didn't the same thing happen with the Lois Lerner emails - and that was on a government server.

When did an unsecure account on a public server become safer than an account on a private server? You do know that emails on AOL could be read by some of the people working at AOL don’t you?

Are you you not aware that GWBush, Dick Cheney and several others in their administration conducted public business on a private server?

An individual cannot "wipe clean" a public server. They, obviously, can "wipe clean" a private server. "Safer" is not the issue in Hillary's private server. It is the ability to hide stuff - subpoenaed emails for example.

There does not seem to be a right wing talking point that you disagree with. If the "Dems were looking to stall things..."   Why did they not hold up Gorsuch? What was the rush to cram this guy through? (Gamble vs. USA) Why did they not release over 70% of the documents they asked for? When Sotimayor was nominated she had been a judge already for a number of years, the GOP asked for and got documents from her HIGH SCHOOL volunteer work. pretty ridiculous!!!!

Gorsuch was in a Presidential election your and long standing tradition is that when there is a Party split between the Congress and WH nominations do not occur in such years. That did not apply in the case Kavanaugh.

When did this ‘long standing tradition’ start? Obviously it wasn’t in effect in 1987 since Stevens was nominated by Reagan and confirmed by a Democratic Senate. Looking at history, this long standing tradition’ started in 2015.

Kavanaugh doesn't have to prove anything - his record is his proof.

You mean like Hillary?  All those fake charges (remember Benghazi?) and the worst they could say is that she was not careful enough handling confidential emails.

When will Trump apologize to Ford for mocking her at a rally?

You are off topic, but - Hillary got off the hook due to the corruption of the DOJ under Obama. Trump did not mock her - her own words did, he merely repeated them.

What is the number of this conspiracy theory?

That's your only defense of her and the corrupted Obama DOJ?

And - how did the President mock Ford by quoting her own words? Seems like she mocked herself.

No, I just don’t believe stupid conspiracy theories. At least eight ‘investigations’ by the Republicans who hated Hillary with a passion were unable to turn up anything criminal and you blame the DOJ. I agree that the Republicans are incompetent but one would think that after 30 years of ‘investigating’ they would have stumbled onto one act that was criminal if any were to be found.

It wasn't me that brought Hillary into this. However, did classified data not get to Weiner's computer? Were subpoenaed emails not destroyed? Was there no a "tarmac summit"? Did Comey not say that she had violated the rules but he couldn't prove that she intended to?

Where is the "stupid conspiracy theory" in that.

You listed many in your first paragraph.

Did I???  Were emails under subpoena not destroyed?

Yes, you did. Hillary had nothing to do with the emails being destroyed at that time. The person who wiped the drive said that it was supposed to have been wiped months before and when he saw it had not been he did it then not knowing what was on the drive or that there was a subpoena for it.

Did she not fail to deliver the subpoenaed emails?

Since she didn’t have them how could she have delivered them?

Tell me again about how Trump wants us all to practice due process of innocent until proved guilty.  I LOVE hearing that fairy tale from the fairies on the right.  Hillary was investigated by THREE Republican Congressional Committees with no wrongdoing. By the FBI with no finding of wrongdoing.

Ah the fake and misleading news from the Republican party marches on.
