Truth is a defense against suits brought for libel or slander. Falsehood must be proven by the plaintiff for any recovery for damages. The criteria for proof of falsehood varies from state to state. Public figures are held to that criteria.

I think it’s critical to underscore what you wrote:  Truth is an ABSOLUTE defense to a libel claim.

 

It’s an underpinning of our right to free speech.  If Trump wants it to be easier to sue, that means he wants to punish those who are telling the truth.

Trump is blasting the well documented book, Fear, by Bob Woodward as completely made up.  He wants Congress to "change the libel laws" because they tie his hands. 

 

Now, let's look at this claim (false and/or misleading?). Trump has used lawsuits as a weapon against his enemies without regard to who is telling the truth for decades. Yet, he will not file a suit against Woodward.  Why? Because he would a) lose and b) have no defense against the truth.  It would be great theater though. 

 

The other problem is that truth is always a valid defense against a claim of libel.  No matter how much they change the law, that is going to stop Trump's suit. 

 

Finally, he is going up against Bob Woodward. Unlike Trump, he has been there and done that.  He knows how to document the facts in his book and he has mountains of corroboration he has not made public sitting in files someplace safe. It would be the ultimate grudge match between Woodward's competence and the Trump administration's incompetence.
