No. The law does not require zero tolerance. As I stated elsewhere, the Attorney General has broad prosecutorial discretion whether to charge someone or not.  And what to charge then with. That’s why people can plea bargain. For example. the prosecutor can drop the murder charge in exchange for the lesser included offense of manslaughter, if the defendant testifies against his accomplice.   Other prosecutors decide not to press certain charges, or they drop others, because they are balancing the use of state resources vs. the severity of the crime.

Sessions was never required to go zero tolerance. Of course, he certainly has the authority to do so.

WRONG.  What you're saying is that people have the right to decide what laws should be enforced.  First, I understand that it happens but that doesn't make it right.  There are cases where prosecutors decide not to prosecute due to lack of evidence.  That's because they cannot prove the case.  There are probably cases in which prosecutors decide on their own not to pursue a case, but they can and should be fired for that because their job is to prosecute not decide what laws they like.  And yes there are plea bargains but that is completely different from deciding not to prosecute.  And there were also been numerous cases where Obama, as well as other Presidents, took it upon himself to decide what the law should be.  And the Supreme Court ruled that was unconstitutional.  As I said, the Constitution clearly states that it is the Presidents duty to ensure "that the Laws be faithfully executed."

But, as I also said before, in the spirit of fair play, I'm willing to compromise.  I'll support you in saying this particular law should not be enforced as long as you agree to support not enforcing laws I don't like.  And the point is that laws are nothing more than the set of rules that make us a civilized society.  You and I don't get to decided which we like and which we are going to ignore.  At least not without consequence if we get caught.  And that's why we have a procedure for changing the ones that are out of date and/or wrong.  And that procedure states that ONLY Congress can do that.

Der Trumper MIGHT write an EO, but rest assured it will solve NOTHING for more than a few weeks. See, there's those 2000+ children under 10 the scum has ALREADY shipped off to contractor operated concentration camps without so much as a BED for the infants. How will he reunite them with their parents? The kids cannot tell them who they belong to - THEY'RE TOO YOUNG TO TALK!

That and the 6th Ameidment that says holding people without criminal charges for more than 72 hours is Unconstitutional is going to prove insurmountable for the moron in chief, and he's praying congress will find a way to bail him out.

Good luck with that Donny - the Republicans in the House are terrified of doing ANYTHING that might appear to help refugees because their deplorable and vile base will vote them out if they do.

Just read the comments from the RWer's on this blog - they see all the refugees as CRIMINALS, regardless of age, and have no concern whatsoever for what might be done to the infants and toddlers whose parents had the nerve to try and find a better life in America without becoming white and rich FIRST.

A Democratic Congressman tried to get in to one of the contractor operated concentration camps set up to process the children, was denied entry, came back with half a dozen other Congressmen and was let inside but could not take pictures or try and talk to the kids.

He reports THEY DON'T EVEN HAVE BEDS. Its just a big room where they get mylar "space blankets" to keep warm at night as they sleep on the floor. The only adult the kids can see is in a guard tower overlooking the Stalag.

END AMERICA'S SHAME!

VOTE OUT THE NRAGOP IN NOVEMBER.

Neither your or I have any idea of who will be our next President, hoping that he will be a man that will bring  morality, outstanding qualities, a good knowledge of the Rule of Law and the Constitution, and that will govern, with not only intelligence but with the moral values that we have always wanted in our President.

you guys are hung up on phones today! How about all those "freebies" your President gives to Russia? But with collusion, goes with the territory. Like constantly proclaiming how good they are, and they must be placed back in the G-7 and on and on. He praises Putin and Un more than our allies!!

Over and over and over liberals keep telling us how bad Trump is for his policy of separating children from their parents.

But there is no such policy.

The Zero-Tolerance policy issued by Attorney General Jeff Sessions simply states that U.S. Code 8 U.S.C. § 1325(a) will be enforced. That's it. That's the policy.

No where does U.S. Code 8 U.S.C. 1325(a) require that children be separated from parents.

That was a policy created by "SPANKY" Trump himself; he didn't even use an Executive Order.

It backfired as many of his policies have.

The difference is that other "BACKFIRED" policies were withdrawn QUIETLY; this one was noisy.

Now "SPANKY'S" in a corner so he has to make as much noise about lifting his own policy as he can.

This will convince his CULT that he is helping people. Thus, his use of an EXECUTIVE ORDER. He could've made a phone call days ago and ended this policy over the phone.

But he will make a big deal of signing an Executive Order so he can be the center of attention.

Another opportunity for liddle donnie to make it all about himself and how wonderful he is...

It will be quite interesting to see what he will sign if anything or have Sessions do the work for him.
