It is a legal question:

 

Which federal law decides who will lead the CFPB — the Federal Vacancies Reform Act, which gives the president the ability to fill many open positions in the executive branch, or the Dodd-Frank financial reform that created the bureau in the first place?

 

Edited to also add:

There is and has been an ongoing court case, PHH v. CFPB, that is currently before the US Court of Appeals for the District of Columbia which could complicate the situation even more. The case deals with the constitutionality of the CFPB’s single-director structure and Dodd-Frank’s provisions that the agency’s director can only be terminated with cause.

 

When laws conflict or if there is a power hierarchy to close off an agency of the government, the Courts will have the final say.

I disagree. There was a documented process for sucession and if Trump wanted to go around he should have done so without all the chaos. a) he loves chaos and b) he has no clue how a well run government should operate. But then, he is the head of the party which cannot govern. 


The only way "around" the sucession is to break the law. This is no problem for Der Trumper who has devoted his life to ignoring laws, but now Republicans have a very clear case where their POTUS has committed (another) crime and we'll see if GOPers are in favor of a Government of Laws or a Government of Der Trumper. If as I suspect the GOPers perfer the latter, I'll drop the inuendo and start calling him Der Fuhrer. It does go with Lemontop's long standing admiration of Nazis.

Yet another example of Trump created chaos in our government as Trump appoints a second person to temporarily  lead the same agency. If this had happened to Obama, he would have researched the law, decided on a plan of action, gathered the parties together, and arranged for a smooth second transition.  Trump just creates another mess. 

 

The man is completely incompetent. Had he not been born rich, he would be starving under a bridge now.
