The Trump administration and ICE in particular don't want the state of California or any other sanctuary city to do their job. Instead, for safety reasons, ICE informs local police where they are doing a raid. It is NOT the right of California (or the city Mayor) to sabotage that raid by informing MS13 (who are illegal aliens) about the raid.


 

May have to agree with you on this one. But let's see what happens with the DOJ lawsuit. This should be interesting.

I assume your citation is correct but it is also not applicable. Much like what happened with escaped slaves prior to the Civil War, states and cities cannot be forced by the Federal government to assist in enforcing federal laws. While a city could not shelter an illegal in city hall, they are under no obligation to notify ICE that an illegal is in their custody. In fact, they are under no obligation to check the status of any of the prisoners under their care. 

 

If Trump does not like it, he simply needs to rewrite the part of the Constitution which limits the powers of the Federal government. I am certain that would be easy at this point in his presidency. 

 

The term “sanctuary,” as used in this context, does not mean that a city or institution will conceal or shelter undocumented immigrants from detection. Rather, sanctuary policies might, among other things, commit a city to serving all individuals without regard to immigration status, protect the privacy of community members by keeping their immigration status confidential, or direct law enforcement officers not to investigate, arrest or hold people solely on the basis of immigration status.

Sanctuary policies are an exercise of basic state and local powers to regulate for the health, safety and welfare of their residents.
