How Obama/Biden Wrecked the U.S. Medical Device Industry



As lawmakers ponder ways to bring back U.S. manufacturing of pharmaceuticals, their raw materials, medical supplies, and devices, it must be remembered a major part of this problem which has come back to bite us was created by the Obama/Biden administration and the medical device tax that was included in ObamaCare that was supposed to defray the costs of this doomed-to-failure new entitlement program.

 

As part of the Orwellian-named Affordable Care Act, sales of medical devices from implants to MRIs, research equipment and surgical instruments were to bear a 2.3 percent tax. The tax would be on gross sales and not just profits. Even packaging, shipping, and warranties were included when calculating what was to be taxed.

 

Because the Affordable Care Act was so unaffordable, it needed a running head start on revenue with imposition of the new tax beginning on January 1, 2013, while ObamaCare itself would begin a rolling implementation in 2014 with its more harmful aspects and the revelations that, no, you couldn’t keep your doctor or your plan even if you liked them.

 

We would have to wait to find out that premiums would skyrocket, not decrease $2,500 as promised in another Obama/Biden lie, and deductibles would be so high that many of those with insurance couldn’t use it. Taxes first, questions later.

 

Health care equipment manufacturers were not amused and there were predictions that this onerous tax on medical devices would for makers overseas and into the welcoming arms of China. As Bill Flax wrote in Forbes in October 2012:

 

Cook Medical, America’s largest privately-owned medical device manufacturer has been adamant that shrinking margins may force investment overseas. “Cook will no longer be able to expand our manufacturing in the United States,” said company spokeswoman Allison Giles. “We’ve always resisted going abroad” but due to diminished returns “decisions will have to be made.”    


Cook scuttled plans for five additional plants across the Midwest. It expects the device tax could cost $30 million annually, roughly equivalent to constructing its new Canton, IL factory. Says the company, “that’s one less facility per year that we’re going to be able to use because of the tax.”

 

Apart from forcing companies to cancel expansion plans and/or move overseas, one immediate effect of the medical device tax was to destroy jobs in an industry belatedly considered as part of our national security in an age of China-spawned pandemics. It was put on hiatus in December 2015 due to its disastrous effects on the medical device industry. It was scheduled to return at the end of 2019 until  President Trump killed it, forcing it to be included in a  federal spending package that he signed into law last December. As the U.S. Chamber of Commerce noted in February 2017:

 

From 2012 to 2015 the number of medtech jobs fell by almost 29,000. The decline started in 2012 when companies were preparing for the medical device tax to go into effect and then accelerated in 2013 and 2014.

A report and white paper from Roth Capital warned of the calamitous impact the device tax would have on the medical device industry, healthcare providers, and patients:

 

Roth also surveyed companies on their latest plans to manage through the implementation of the Medical Device tax next year.  The report determined that (1) over 80% would either cut jobs or forego new hires and (2) more than 75% would either cut or forego new R&D projects as a result of the tax.  The report also found that 85% of companies would be expanding overseas.  

Even when it was in hiatus, the Obama/Biden medical device tax hung over the medical device industry like the proverbial sword of Damocles. Outsourcing didn’t seem such a bad thing As Rush Limbaugh has noted, liberal progressives like Obama and Biden employ a static analysis that says you can raise taxes and human and corporate behavior won’t change:

 

Do you all remember this thing called Obamacare? I’m sure you do. Do you remember the medical device tax that Obamacare instituted? Like all liberals, Obama believed that people that make things will pay anything. You put a tax on ’em, they’ll just keep paying the tax and they’ll just keep making the device. You put a tax on yachts, and people will pay the tax…

 

Well, guess what? The people that manufacture medical devices fled the USA, and they went overseas to various places to get ’em made. One of the places they went was China. They also went to Mexico. They went to places in Europe. And now people complain about a shortage. They want to chalk it up to somehow a fault or a deficiency of capitalism or of the United States. No siree, Bob. It was a by-product of a tax increase called Obamacare on medical devices.

Let us also not forget that during the H1N1 swine flu pandemic during which no foreign travel was suspended and a national emergency wasn’t declared until six months in, Democrats blame shortages of things like face masks and ventilators on Trump’s alleged ineptitude. Let’s roll the tape

But the reason we don’t have the respirator masks goes back to the Obama/Biden administration when they were advised to replenish the stockpile that had been used during the H1N1 swine flu pandemic.

 

But it never happened, they never did it, according to the Washington Examiner:

The George W. Bush administration published the National Strategy for Pandemic Influenza plan in 2005, which called on the federal government to distribute medical supplies from the Strategic National Stockpile governed by the Health and Human Services Department in the event of an outbreak,

 

In 2009, the H1N1 outbreak hit the United States, leading to 274,304 hospitalizations, 12,469 deaths, and a depletion of N95 respirator masks.

 

A federally backed task force and a safety equipment organization both recommended to the Obama administration that the stockpile be replenished with the 100 million masks used after the H1N1 outbreak.

 

Charles Johnson, president of the International Safety Equipment Association, said that advice was never heeded.

 

“Our association is unaware of any major effort to restore the stockpile to cover that drawdown,” he said.

We need to remember the Obama/Biden days of swine and poses.

The basic theory of taxation says; the more you tax something, the less of that activity occurs. That logic is now behind a move to squash unpopular medical device taxes in the US for good. But is the tax as bad as it’s made out to be?

 

In the US, sales of medical devices are supposed to be subject to a 2.3% tax under the Patient Protection and Affordable Care Act (ACA). This clause was signed into law under the Obama administration in 2013. However, this tax is now reaching the end of its fourth year on Democrat-implemented hiatus, and the med tech industry is putting increasing pressure on Congress to scrap it for good.

Of course they are as they want the money the ACA took away from them back in to their profit. All remember the Scooter Store. It sold mostly to Trump type supporters and they did not even realize they were being ripped off. The ACA saved them money, but they hate the ACA for doing that. Experts proved correct again.

How many myths and distortions of reality can they make up in one thread? Obamacare did NOT take over health insurance, or a major portion. I think something like 85% of Americans are not part of Obamacare. In other words, Obamacare is very important, but it's still just a program for a small percentage of Americans.

 

The facts are very clear, under Obamacare, health insurance was provided by PRIVATE COMPANIES competing against one another. But don't tell Trump supporters because facts and the truth are irrelevant in their world. 

 

You can listen to Trump Supporters make up stories or you can get the facts. Please read the following. Despite its problems, Obamacare positively changed the way health care is implemented in America. Here are some of the major changes which improved our way of life. 

  • You can no longer be denied health insurance because of Pre-Conditions and it eliminated the Pre-Condition Penalties (Trump is trying to overturn this clause)
  • The unemployed can buy insurance
  • Those who are Self-Employed can buy insurance
  • All preventive care is free to the patient

Don't you love how Trump World takes something which is true, a Medical Device tax, and uses that to claim Obama destroyed the U.S. Medical Device Industry? They are very good with their lies and distortions of realty. 

 

As stated before, Obama brought health insurance to millions of Americans who never had it before while Trump spent the last 3 1/2 years trying his best to take away that health insurance. The bigger question should go to the people on Obamacare and ask them what's more important,  keeping their health insurance or a medical device tax?

There are 80 million Americans that do not share your opinion of the Affordable Care Act, I am just one of them.  It was and is unsustainable.  It did not work for everyone.  It was however a government grab of a very large part of the American economy and it failed miserably...

 

And by the way, the tax drove the medical device industry off our shores.  If you want more of something you don't tax it, surely an independent like you must know how this works...

Well lets see who Biden is running against. Trump: Court case for rape now in court, rapped his own wife, paid off hookers to the tune of about 1 million, Trumps legal council serving prison time, and Trump an un indited co-consperitor, Trump U put out of business for fraud and had to pay 24 million, Trump Charity put out of business for fraud, lies over 90% of the time, was impeached for breaking the law with Ukraine, increased the Federal debt to over 1 trillion $, puts children in cages on border, destroyed US economy, makes people work in meat plants then kills them by no safety regs.  

Now how could anyone like Trump deserve even one vote.

trump and supporters have railed against and tried to destroy Obama and the ACA, with Obama trying to provide healthcare coverage for more Citizens. 

But, once again for trump and his supporters: where is the great healthcare plan that trump wants to propose...as in, there has been no proposal, and apparently no plan. 

 

Or is it just another lie by trump, just like his promise about testing for the virus...

They might be paying a little more upfront, but in the grand scheme of things this money would extend access to their product.

 

When questioned about the tax in a 2012 interview, President Obama stated: “The healthcare bill is going to provide those healthcare companies 30 million new customers…When you have 30 million more people coming in, you’re going to make money, you can do a little more to help facilitate and make sure people are getting the healthcare they need.”

President Obama requested funding to replace the N95 masks, but REPUBLICANS in the Senate refused to include funding even when they were a minority in the Senate using the fillibuster. The Toad has not only ignored adding to the Emergency Stockpile, the little twerp CANCELLED THE MAINTENANCE CONTRACT for the equipment in 2018, rendering thousands of ventilators and other essential material USELESS because they were not properly maintained.

 

The death toll is ENTIRELY a Republican responsibility, including the FACT the GOP still demands States BID AGAINST EACH OTHER, insuring MAXIMUM PROFITS for the Corporate Oligarchs and MINIMUM effective distribution of the life saving material. Toad even had his minions OUT BID States for material so he could shovel it to his political supporters and the swing States.

 

Meanwhile, Toad's tadpoles continue to strike down the "social distancing" that HAD begun to slow the death toll, which will now spike giving GOPers a justification for cancelling the elections because they will never allow absentee voting at a level needed to have a fair election.

Why didn't Trump and the Trump party fix it. it's been almost four years  They gave tax cuts and tax credits to other industries, why not medical devices.

 

Even now,  the Trump party wants a 16 billion dollar bailout for the meat industry, but won't make N95 masks or ventilators.

 

It's up to the states to procure N95 masks and ventilators but the federal government can bail out meat?

Easy to figure this out.  The president and vice president see no use or value in masks.  HOWEVER, IMPOTUS will not hesitate to use the DPA when he's senses a disruption in his steady "hamberder" supply.

That's what he's doing now...  Obama set a bunch of obstacles in this President way with the intention of derailing his Presidency.  

 

The good news is, it is all coming out now, day by day.  

 

FISA Abuse, Mueller Hoax, Ukraine Hoax, Impeachment Hoax...  It's a very long list.

That's what he's doing now...  Obama set a bunch of obstacles in this President way with the intention of derailing his Presidency.  

 

The good news is, it is all coming out now, day by day.  

 

FISA Abuse, Mueller Hoax, Ukraine Hoax, Impeachment Hoax...  It's a very long list.  

 

The DOJ, FBI and Intelligence agencies are all being fixed and will soon return to their former premier status as the best in the world.  The Obama Administration weaponized many of our agencies but it is being dealt with.  All that in spite of the intentional corrupt actions of the Obama Administration.  It's a fact.  Much more to come.

But it never happened, they never did it, according to the Washington Examiner:

The George W. Bush administration published the National Strategy for Pandemic Influenza plan in 2005, which called on the federal government to distribute medical supplies from the Strategic National Stockpile governed by the Health and Human Services Department in the event of an outbreak,

 

In 2009, the H1N1 outbreak hit the United States, leading to 274,304 hospitalizations, 12,469 deaths, and a depletion of N95 respirator masks.

 

A federally backed task force and a safety equipment organization both recommended to the Obama administration that the stockpile be replenished with the 100 million masks used after the H1N1 outbreak.

 

Charles Johnson, president of the International Safety Equipment Association, said that advice was never heeded.

 

“Our association is unaware of any major effort to restore the stockpile to cover that drawdown,” he said.

EVEN IF the above statement were true, let's face facts:

1. President Obama's last full year in office was 2016.

2. tRump has had almost four years in office since that time.

3. tRump failed to check the stockpile, maintain whatever was there, nor did he replenish it.

4. It is 2020 and this is his (tRump's) watch now! 

 

And despite tRump's early declaration in which he claimed no responsibility for the dire situation America now finds herself in, it was then and it IS "now"  his responsibility to at least do the job he so vigorously lied, cheated, and connived to obtain.

And we all know IMPOTUS never takes responsibility.  It's easier to blame the other guy Obama.

Republicans, remember didn't heed the warning that OBL was going to hijack planes and crash them into buildings from the intelligence community.  Bush claimed he wasn't told which flights and on which day and didn't share the information with the FAA.  The GOP is not a party with good leadership!  Always looking for someone else to blame.
