FBI, DOJ announce sweeping new FISA reforms in aftermath of Russia debacle

 

Changes include creation of new audit office to ensure accuracy of surveillance warrant applications.

Seeking to address massive failures during the Russia probe, FBI Director Chris Wray and Attorney General William Barr  announced Tuesday sweeping new reforms to ensure future warrants targeting Americans under the Foreign Intelligence Surveillance Act are accurate, legal and free from political influence.

 

The changes include the creation of a new audit office to review FISA applications and new vetting to ensure the accuracy of agents' evidence when seeking to spy on U.S. citizens. The Justice Department also created new protocol governing when surveillance can be conducted on elected officials and candidates for office.

 

The changes, memorialized in two separate memos, are an outgrowth of a DOJ inspector general report last December that identified 17 instances of misconduct, erroneous evidence, factual omissions and mistakes in the pursuit of a FISA application targeting former Trump adviser Carter Page during the Russia collusion investigation. Last month, a former FBI lawyer pleaded guilty to falsifying evidence during the probe.

 

"FISA is a critical tool to ensuring the safety and security of Americans, particularly when it comes to fighting terrorism. However, the American people must have confidence that the United States government will exercise its surveillance authorities in a manner that protects the civil liberties of Americans, avoids interference in the political process, and complies with the Constitution and laws of the United States," Barr said. "What happened to the Trump presidential campaign and his subsequent administration after the President was duly elected by the American people must never happen again."

 

Wray said the new changes build on the more than three dozen reforms he announced to FISA procedures after the IG report became public.

 

"Since the Inspector General's Crossfire Hurricane report was issued last December, I have made clear that it describes conduct that was unacceptable and unrepresentative of the FBI as an organization," the FBI director said. "That's why I immediately ordered more than 40 corrective actions, including foundational FISA reforms, many of which went beyond those recommended by the Inspector General. The FBI has been working diligently to implement these corrective actions. The additional reforms announced today, which we worked on closely with the Attorney General's office, will build on the FBI's efforts to bolster its compliance program."

 

The first memo makes improvements to the FBI's internal FISA compliance program, including the creation of the Office of Internal Auditing. You can read that memo here.

Barr's second memo augments Wray's earlier reforms and includes new oversight protocols to ensure that any FISA warrant to surveil federal elected officials, candidates for federal elected office, or their advisors or staff "is justified, non-partisan, and based on full and complete information."

The following comment is technically correct but an inaccurate summation of what happened.

Muller was able to establish a very persistent connection between the Trump campaign and Russia, but he couldn't prove it was a conspiracy.

If you want to talk about "Abuse of Power", all you have to do is look at Comrade Trump. who was impeached for abusing his power. He has no respect for the Rule of Law, and he calls the FREE PRESS an Enemy of the People.

 

Another Abuse of Power by Trump, is making Barr the AG. He LIED about the Mueller Report and interfered in legal cases as if he was Trump's personal attorney. Unfortunately, Trump Cult members will never complain about this because the Cult Leaders is never wrong.

The purpose is to point out the abuses of power by the previous administration minions that led to the biggest fraud in US history. 

 

The justice dept under the current administration is draining the swamp... this is part and parcel of the problems that voters want fixed.

not a Dem, but reality is the world I live in. It is ruled by facts, science, a respect for the law and respect for others who are worthy of respect back. Sorry but I can't find anything about Trump to which I can say that. That is my reality.

The Russian investigation wasn't a debacle. It was a much needed national security investigation. Did the FBI make mistakes with its FISA warrants? Yes, but that doesn't change the nature and importance of the Trump campaign's connection to RUSSIA. 

Mueller spent almost 200 pages describing “numerous links between the Russian government and the Trump Campaign.” He found that “a Russian entity carried out a social media campaign that favored presidential candidate Donald J. Trump and disparaged presidential candidate Hillary Clinton.” He also found that “a Russian intelligence service conducted computer-intrusion operations” against the Clinton campaign and then released stolen documents.

While Mueller was unable to establish a conspiracy between members of the Trump campaign and the Russians involved in this activity, he made it clear that “[a] statement that the investigation did not establish particular facts does not mean there was no evidence of those facts.” In fact, Mueller also wrote that the “investigation established that the Russian government perceived it would benefit from a Trump presidency and worked to secure that outcome, and that the Campaign expected it would benefit electorally from information stolen and released through Russian efforts.”

maybe if Trump wasn't doing "business" with Russia in 2016 Obama would not have had to investigate! OOPS!!!! Remember Trump said a million times, " I don't have any business with Russia." Ooops. Forgot about the collusion part and forgot about the Moscow Trump Tower he is still trying to build.

Barr is, in my opinion, disliked by the hatin' dems and other anti-Trump people for the same reason President Trump is. He is bluntly honest, is his own man and doesn't care what the haters say!  Because he stands up for right over wrong, says it like it is and will tell the truth no matter who it hurts.  Yes, including President Trump if that were the case...

The issue may not be partisan, but people are.

 

I support it and I think it's a step in the right direction at protecting Americans' civil liberties -- including presidential candidates' civil liberties.

 

I haven't heard any Democrats support these improvements, yet. Then again, it is people who are partisan.

 

Since some people in government got caught doctoring FISA Reports so they could spy on political opponents, it makes sense to add an extra layer of protection.

 

Let's face it, none of these improvements would ever have been made if Hillary was president. In that sense, we have to give Trump some credit here.

 

Besides, Barr probably sees that it's likely Trump will lose his re-election and Democrats will be in charge. He doesn't want the intelligence community running wild under a Biden / Harris Administration and spying on Republicans, again.

We already saw all those endorsements by people in the intelligence community supporting Biden. 

It's a good move.
