I agree that one argument for a lower capital gains rate is to get you to invest. I would point out that you seem to have made the argument for increasing the capital gains rates with your Buffet example.
The other sneaky devil is the AMT which if you tried the cap gains gambit with no income, the AMT might just bite you! Also, increasing the cap gains rate would cause tremors in the stock market if not a crash!
